Welcome to the African Transitional Justice Network (ATJN). These Terms & Conditions (“Terms”) govern your access to and the use to and use of the website located at africantjnetwork.org.za (the “Platform”), including all content, services, features, and functionality offered on or through the Platform.
- AGREEMENT TO THE TERMS OF USE
The Platform may contain articles, reports, events, downloads, topics of interest pages and other products that may be available from time to time. Any person that accesses or uses the Platform as a (“Visitor”) agrees to be bound by the terms and conditions detailed here. The terms below contain conditions, disclaimers, and other provisions, some of which limit the ATJN’s liability. Any person that does not agree or comply with these terms should not access or use the Platform.
- APPROPRIATE USE
Visitors hereby agree not to:
- Use the Platform that limit or constrict the availability or quality of the Platform’s features;
- Use of the Platform for any unlawful purpose or in violation of any applicable local, national, or international law;
- Upload, submit, or otherwise distribute unlawful, defamatory, abusive, obscene, or offensive materials;
- Use the Platform in any way that may violate third party rights including, but not limited to, copyrights or privacy; and/or
- Attempt to gain unauthorised access to any portion of the Platform, other users’ accounts, or computer systems or networks connected to the Platform.
- CONTENT OWNERSHIP AND INTELLECTUAL PROPERTY
- All content and materials available on the Platform, including but not limited to text, graphics, logos, images, downloadable files, and data compilations (“Content”), at the property of the ATJN or its licensors and are protected by copyright, trademark, and other intellectual property laws.
- Visitors acknowledge that they do not acquire any ownership rights by downloading or copying Content from the Platform.
- Visitors may access and use Content solely for their personal, non-commercial use, unless express written permission is granted. Any other use, including reproduction, modification, distribution, or republication of the Content, without our express written consent, is prohibited.
- Any attribution of the work by visitors must be done in the manner specified by the author or licensor (but not in any way that suggests that they endorse the visitor or use of the work).
- ATJN values intellectual integrity and the highest standards of academic conduct. ATJN considers any form of plagiarism as a serious offence. Should a visitor suspect any form of plagiarism, contact info@csvr.org.za with exact details of the suspected plagiarism and links to the original source.
- ATJN reserves the right to ‘repackage’ Content for distribution through electronic channels of communication.
- ATJN’s name and logo cannot be used without express written permission. Written permission can be requested via email to info@csvr.org.za.
- VISITOR CONTENT
- If a visitor submits content to the Platform as a visitor (e.g. comments, posts, files), they grant ATJN a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in any media.
- Visitors represent and warrant that they own or have the necessary rights to grant this licence and that their content does not violate any third-party rights.
- LINKS TO OTHER WEBSITES
- Links on the Platform may connect visitors to external or third-party websites that are not related to ATJN or under its control. ATJN is not responsible for the content of external or third-party websites that may be accessible or displayed through external links on the Platform.
- The presence of these external links does not represent ATJN’s endorsement of the views or content of these third-party websites.
- Navigating to external websites through links on the Platform is done at the sole discretion of the visitor, and the ATJN expressly disclaims any liability for any content that appears on any external site.
- WAIVER AND SEVERABILITY OF TERMS OF USE
The failure of ATJN to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision. If any provision of these Terms of Use is found by a court of competent jurisdiction to be invalid, the Parties nevertheless agree that the court should endeavour to give effect to the Parties’ intention as reflected in the provision and the other provisions of these Terms of Use shall remain in full force and effect.
- DISCLAIMER OF WARRANTIES
The Platform and all Content and services are provided on an “as is” and “as available” basis without warranties of any kind. To the fullest extent permitted by law, ATJN disclaim all warranties, express or implied.
- LIMITATION OF LIABILITY
In no event shall ATJN or its affiliates, directors, employees, agents, or licensors be liable for any indirect, incidental, special, punitive, or consequential damages arising from or related to the visitor’s use of, or inability to use, the Platform or any Content, even if advised of the possibility of such damages.
- AMENDMENTS
ATJN may amend these Terms of Use at any time, and such amendments will be effective immediately upon notice being provided to the visitor. Notice may be provided on the Platform itself, and after posting of the notice, the visitor’s continued use of the Platform will be deemed as acceptance of the modified terms of use.

DATA PROTECTION POLICY
- BACKGROUND
- This Privacy and Data Protection Policy (“DP Policy”) sets out a framework for us to comply with the requirements of the African Union Convention on Cyber Security and Personal Data Protection (Malobo Convention) and the EU General Data Protection Regulation (GDPR) (Regulation (EU) (Regulation (EU) 2016/679).
- This Policy applies to all personal data collected through the African Transitional Justice Network (“ATJN”) website, digital platforms, communications, events, research activities, and partnerships.
- By accessing our website and using any of our services through it, you agree that we may process your personal data as explained in this DP Policy.
- SCOPE
This Policy applies to:
- Website visitors and registered users;
- Network members, partners, researchers, and contributors;
- Event participants, speakers, and stakeholders; and
- Any individual whose personal data is processed by ATJN.
- DEFINITIONS
- Personal Data: Any information relating to an identified or identifiable natural person.
- Processing: Any operation performed on personal data (e.g. collection, storage, use, disclosure, deletion).
- Data Subject: The individual to whom the personal data relates.
- Controller: The entity that determines the purposes and means of processing personal data (ATJN).
- Processor: A third party that processes data on behalf of the controller.
- PRINCIPLES GOVERNING DATA COLLECTION
ATJN collects and processes personal data in accordance with the GDPR principles:
- Lawfulness, Fairness, and Transparency: Data is collected lawfully and transparently
- Purpose Limitation: Data is collected for specified, explicit, and legitimate purposes.
- Data Minimisation: Only data that is necessary is collected.
- Accuracy: Data is kept accurate and up to date.
- Storage Limitation: Data is retained only as long as necessary.
- Integrity and Confidentiality: Data is processed securely.
- Accountability: ATJN is responsible for demonstrating compliance.
- CATEGORIES OF PERSONAL DATA COLLECTED
ATJN may collect the following categories of personal data:
- Identification and Contact Data: Name and surname, email address, organisation and role, and country/region.
- Professional and Engagement Data: Network membership information, event registration and attendance records, and contributions to publications, discussions, or research.
- Technical and Usage Data: IP address, browser type and device information, website usage and interaction data, and cookies and similar tracking technologies.
- Special Category Data: ATJN does not intentionally collect special category data, such as data revealing racial or ethnic origins, political opinions, or health data, unless it is strictly necessary for a specific project or research purpose and explicit consent has been obtained, or another lawful basis under Article 9 of GDPR is applicable.
- Personal Data of Children: ATJN may only process the personal data of a child if we have the written and informed consent of the child’s parent or legal guardian.
- PROCESSING OF PERSONAL DATA
- ATJN undertakes to comply with the Malobo Convention and GDPR principles at all relevant times and process your personal data lawfully and reasonably, so as not infringe unnecessarily on your privacy.
- Personal data may be collected through website forms and registrations, email communications, event registrations and attendance lists, surveys and consultations, and/or cookies and analytics tools.
- All data collection methods are designed to ensure transparency and informed consent where required.
- ATJN undertakes to process your personal data only for the purpose for which it is intended, to enable us to conduct our activities as may contractually be determined.
- Whenever necessary, we shall obtain the voluntary, specific, and informed consent (“Consent”) from you to process your personal data. We shall ensure that the consent processes will be context-appropriate, informed, and revisitable, especially for research participants.
- Where we do not expressly seek your Consent, the processing of your personal data may be done in terms of another legitimate ground such as:
- a legal obligation or regulatory requirement placed on us (including for purposes related to the maintenance of law and order, or the personal data is required for the conduct of proceedings in any court or tribunal, where these proceedings have commenced or are reasonably contemplated);
- to protect a legitimate interest (for network administration, security, and improvement of services) that requires protection (provided these interests do not override the rights of data subjects); and/or
- out of contractual necessity (to manage memberships, participation, or services requested).
- ATJN shall stop processing your personal data as soon as the required Consent to do so is withdrawn by you or if a legitimate objection thereto is raised by you.
- DATA STORAGE, RETENTION, SHARING, AND RISK MITIGATION
- ATJN recognises that transitional justice research and related activities may involve heightened risks to data subjects, including but not limited to risks of reprisals, surveillance, intimidation, stigmatisation, or political targeting. In such contexts, ATJN commits to implementing additional and proportionate safeguards, which may include:
- Enhanced data minimisation and anonymisation/pseudonymisation measures;
- Restricted access controls and heightened security protocols;
- Careful assessment of necessity and proportionality before collecting identifiable data;
- Context-sensitive and ongoing consent processes; andRisk assessment tailored to the political, social, and security environment in which data is collected.
- These safeguards are applied in line with the Malobo Convention, applicable law, and ethical standards governing human rights and transitional justice research. ATJN shall implement appropriate technical and organisational measures to protect personal data, including secure hosting environments, access controls and role-based permissions, encryption where appropriate, and regular system updates and security monitoring.
- Access to personal data is limited to authorised personnel and service providers bound by confidentiality and data protection obligations.
- Personal data is retained only for as long as necessary to fulfil the purpose for which it was collected, including active membership or engagement and legal, contractual, or reporting obligations (including donor requirements).
- ATJN shall destroy or delete records of your personal data (so as to de-identify your personal data) as soon as reasonably possible after the time period for which we are entitled to hold the records has expired, or you withdraw your Consent.
- ATJN undertakes to ensure that your personal data, which we collect and process, is complete, accurate, not misleading, and up to date.
- ATJN may share personal data with service providers (e.g. website hosting, email distribution, analytics), funding partners/donors where required and lawful, and/or public authorities where legally required.
- Where personal data is shared with funding partners or donors, ATJN will, wherever possible, ensure that such data is aggregated, anonymised, or otherwise minimised, particularly in respect of participants or contributors operating in sensitive or high-risk contexts.
- Identifiable personal data will only be shared where strictly necessary, lawful, and subject to appropriate safeguards.
- DATA SUBJECT RIGHTS
Under the GDPR, data subjects have the right to:
- Access their personal data
- Rectify inaccurate or incomplete data
- Request erasure of their data
- Restrict or object to processing
- Data portability
- Withdraw consent at any time
- Lodge a complaint with a supervisory authority
- COOKIES AND TRACKING
- ATJN uses cookies and similar technologies that are necessary for the operation, security, and basic functionality of the Platform, as well as limited analytics to understand usage patterns and improve performance.
- Where cookies or tracking technologies are not strictly necessary, ATJN provides users with clear information and choices regarding their use. Users are informed of cookie usage and may manage preferences through browser settings and, where applicable, through cookie notices or consent mechanisms on the Platform. As part of compliance with consent requirements, the user can either opt-in or opt-out.
- ATJN does not use cookies to conduct intrusive profiling or monitoring, and particular care is taken to avoid tracking practices that could place users at risk in sensitive or politically exposed contexts.
- BREACH NOTIFICATION
In the event of a personal data breach that poses a risk to the rights and freedoms of individuals, ATJN will notify the relevant supervisory authority within 72 hours and inform affected data subjects as required by law.
- ROLES AND RESPONSIBILITIES
ATJN is the Data Controller for all personal data collected. Third-party processers are engaged under written agreements ensuring GDPR compliance.
- POLICY REVIEW AND UPDATES
This Policy is dated as 13 February 2026. This policy is reviewed periodically and updated as necessary to reflect legal, operational, or technological changes.
WEBSITE PRIVACY POLICY
- INTRODUCTION
- ATJN is committed to protecting your privacy. This Privacy Policy explains how we collect use, store, and share your personal data when you visit or interact with the Platform. This policy also explains our privacy rights under applicable law, including the GDPR.
- This Privacy Policy is incorporated into the website’s terms of use. Any person that uses the website or registers on the website acknowledges that they have read and agree to be bound by the terms and condition of the Terms of Use and Privacy Policy.
- DATA WE COLLECT
We may collect the following categories of personal data:
- Information you provide directly: Name, email address, organisation, role when registering or subscribing, and/or content you submit such as comments or uploads.
